Right of withdrawal
The Consumer Protection Code establishes a seven-day period after receiving the product for customers to cancel an online purchase and request a return. This is the Right of Withdrawal, guaranteed by Article 49 of Law No. 8,078/90.
In this case, the consumer does not need to provide any justification for returning the item. The full amount paid, including shipping, must be refunded, and all logistics costs involved in the return process must be borne by the store.
Product defect
In the event of a defect in the product received, articles 18 and 26 of the Consumer Protection Code determine that the deadline for the customer to request the return or exchange of the merchandise is 3 months.
The retailer has 30 days to evaluate the damaged item and take the necessary steps to resolve the issue. If this period is exceeded, the consumer can choose one of the following options:
replacement of the product with a similar one;
immediate refund of the amount paid;
proportional price reduction.
